You cannot file a lawsuit against your employer unless your workplace injury was a result of their intentional misconduct (Laidlow v. Hariton Machinery Co., Inc.). However, you may be able to bring a personal injury claim against another party if someone other than your employer caused your work injury. Such lawsuits are known as third-party personal injury claims.
In addition to filing a workers’ compensation claim, you may be able to bring a lawsuit against a third-party that caused your injuries. Filing a personal injury lawsuit allows you to recover compensation for pain and suffering, as well as other non-economic losses.
