If you are injured in an accident with an Uber driver and your injuries were caused by the negligence of the Uber driver, then you would need to file a lawsuit against the driver, as well as Uber. If the Uber driver was off duty and not ferrying passengers or looking for passengers, then your case would handle like any motor vehicle accident – the fact that the negligent driver worked for Uber would not have any bearing on your lawsuit. However, if you were a passenger in an Uber or the Uber struck your vehicle while the Uber driver was on the clock, then you would file suit against both the driver and Uber.
The reason for filing suit against both the driver and Uber is to get access to both insurance policies: the driver’s personal insurance policy and Uber’s insurance policy that is required by the 2017 law covering New Jersey Uber vehicles. As of 2017, in order for Uber to operate in New Jersey, the company agreed to numerous concessions. One of requirements in the new law requires Uber to pay for an insurance policy on every Uber vehicle that provides comprehensive coverage if an Uber driver is in an accident, whether the collision is caused by the driver or not. If there is a passenger in the vehicle, then the coverage is $1.5 million. If there is no passenger, but the driver is logged into the app and is looking for passengers, then the coverage is lower.
